Terms of Service

Scope of Services:
1.1. Jays Electrical Solutions (“the Company”) provides electrical and data services to homeowners, businesses, and organizations. Our services include electrical installations, repairs, and maintenance in accordance with AS/NZS 3000, as well as data cabling, testing, and certification in accordance with AS/CA S009.


Pricing:
2.1. Our pricing is structured to reflect the value and quality of our services, tailored to the specifics of each project. Before the commencement of any project, we will provide a detailed quote that outlines the scope of work, pricing, and any conditions that may affect the final cost. This ensures transparency and agreement on the financial aspects of our services.


Additional Cost of Price Fluctuations:
3.1. In the event of significant material or labor cost increases due to market volatility or other external factors beyond our control, we reserve the right to adjust our prices accordingly. Such adjustments will be communicated and justified to you, with your consent required before any additional charges are applied.


Additional Cost For Delays:
4.1. Should unforeseen circumstances beyond our control, such as adverse weather conditions, supply chain disruptions, or actions by third parties, delay the project, we may need to adjust the project timeline and costs. In such instances, we commit to transparent communication and agreement on any changes to the project scope and associated costs.


Change Orders:

5.1. Any modifications or additions to the scope of work must be documented through a formal change order process.

5.2. The client shall provide a written request detailing the desired changes, including the scope, timeline, and cost implications.

5.3. The Company will evaluate the requested changes and provide a written change order proposal to the client, including any adjustments to the project timeline and cost.

5.4. The client must approve the change order proposal in writing before any additional work commences.

5.5. The approved change order will become part of the contractual agreement and may impact the project timeline and cost.


Payment:

6.1 Payment methods accepted include cash, credit cards, and bank transfers, ensuring convenience and security for our clients.

6.2 Unless otherwise agreed in writing, invoices are due within fourteen (14) days from the date of issue. For projects requiring substantial resources, materials, equipment, or labour to be committed upfront, a deposit, progress payment, or partial payment may be requested prior to commencement or continuation of the works.

6.3 Where applicable, invoices issued by Jays Electrical Solutions PTY LTD may constitute payment claims under the Building and Construction Industry (Security of Payment) Act 2009 (ACT). Any invoice intended to operate as a payment claim under the Act will state this on the invoice or payment claim document.

6.4 If an invoice remains unpaid after the due date, Jays Electrical Solutions PTY LTD may charge interest on the overdue amount at a rate of 10% per annum, calculated daily from the due date until payment is received in full. Jays Electrical Solutions PTY LTD may also recover any reasonable costs incurred in recovering overdue amounts, including debt recovery fees, legal costs, filing fees, and related expenses, where permitted by law.

6.5 In cases of late payment, Jays Electrical Solutions PTY LTD will seek to resolve the matter amicably and professionally, with a view to maintaining positive client relationships. However, persistent non-payment, failure to respond, or failure to make suitable payment arrangements may result in suspension of further works, referral to debt recovery, adjudication under applicable Security of Payment legislation, or legal action to recover the outstanding amount, including any applicable interest, fees, and recovery costs where permitted by contract or law.


Cancellation:
7.1. Any cancellations must be made in writing at least 48 hours prior to the scheduled service. Failure to do so will result in a cancellation fee reflective of costs already incurred.


Quality of Work:
8.1. The Company is committed to providing high-quality workmanship and materials. We employ skilled and certified professionals who are knowledgeable and experienced in their respective fields. We ensure that our work complies with AS/NZS 3000 for electrical works and AS/CA S009 for data works.


Warranty:
9.1. We stand behind our work with a twelve (12) month warranty covering defects in workmanship and materials, commencing from the project’s completion date. This warranty complements your rights under the Australian Consumer Law, ensuring you receive services of acceptable quality.


Liability:
10.1. While we take every precaution to ensure the safety of our employees and clients, accidents may sometimes occur. The Company carries the necessary insurance coverage required by law to cover any damages or injuries that may occur. However, we recommend that you also carry adequate insurance coverage as a precaution.


Intellectual Property:
11.1. All intellectual property rights associated with our services, including designs, drawings, and reports, remain the property of the Company. Any use, reproduction, or distribution of these materials by any third party is strictly prohibited without our prior written consent.


Confidentiality:
12.1. We treat all client information confidentially and comply with all relevant data protection laws. We will not disclose any information to any third party unless required by law.


Dispute Resolution:
13.1. In the spirit of partnership, we aim to resolve disputes through direct negotiation and mediation. Should these efforts not reach a satisfactory conclusion, arbitration may be considered before any legal action is pursued.


Site-Specific Requirements and Associated Costs:
14.1 Jays Electrical Solutions (“the Company”) operates with its own Site Work Method Statements (SWMS) and uniform policy. While complying with any additional site-specific requirements beyond our standard policies, any costs incurred due to purchasing extra Personal Protective Equipment (PPE) or specialized equipment for compliance will be billed accordingly. Additionally, expenses related to additional labor for form filling, permits, or inductions specific to the site will be invoiced and expected to be covered.

14.2 The client is responsible for providing access to the site for the duration of the project. Additional costs incurred, including but not limited to site parking expenses and expenses for tool and material lock-up and storage if the site is not secure, will be invoiced to the client.

14.3 Costs for vertical access equipment (e.g., scissor lifts, boom lifts) are not included in any service quotes and are assumed unnecessary with access feasible via a standard 6-foot ladder. If specialized access equipment becomes essential, additional charges for their rental and operation will apply, in excess of any previously supplied quote. Clients will be notified of these requirements and the associated extra costs for approval.
